About these terms
These Terms of Use govern your use of paertner.com, the website of Paertner LLC, registered in Arlington, Virginia, United States ("Paertner", "we", "us", or "our"). By using the website, you agree to these terms to the extent permitted by applicable law. If you do not agree, please stop using the website. You can contact us about these terms at hello@paertner.com.
These terms cover website use. They do not replace a proposal, statement of work, services agreement, or other written contract that we enter into with a client. If a signed client agreement conflicts with these terms about the services covered by that agreement, the client agreement controls.
Information and inquiries
The website describes our capabilities, work, and perspectives. Service descriptions, articles, and examples provide general information; they are not a binding offer, a promise of availability, or professional advice tailored to your circumstances. Project scope, deliverables, fees, timelines, ownership, and other commercial terms must be agreed separately in writing.
Submitting a form, sending an email, or requesting a conversation does not create a client relationship, reserve a time, or require either party to proceed with a project. An appointment is confirmed only when we agree on it with you. Information you submit should be accurate and you must be authorized to share it. Please do not submit confidential materials or sensitive personal information before appropriate arrangements are in place.
Acceptable use
You may use the website to learn about our work and communicate with us for lawful purposes. You must not attempt to gain unauthorized access to the website or its administrative systems, bypass security controls, introduce malicious code, interfere with availability, impersonate another person, send spam, or submit unlawful or infringing content. Automated access must not overload the website or circumvent access restrictions.
We may restrict access where reasonably necessary to protect the website, investigate misuse, or comply with applicable law. Nothing in these terms prevents activity that applicable law expressly permits and does not allow us to restrict.
Website content and intellectual property
The website's original text, design, branding, code, and creative materials are owned by Paertner or used with permission, except where third-party rights apply. You may view the website and share links to it for lawful personal or business evaluation. Other copying, modification, publication, redistribution, or commercial reuse requires permission unless allowed by law or an applicable license.
Third-party names, logos, trademarks, and project materials remain the property of their respective owners. Their appearance does not by itself imply endorsement or a partnership. Work identified as a concept is an independent creative exploration and must not be presented as a commissioned client engagement or as evidence of measured business results. Rights in commissioned work are governed by the relevant project agreement.
By submitting an inquiry, you allow us to receive, store, and use the material as reasonably necessary to review and respond to your request, as described in our Privacy Notice. You retain your rights in that material; an inquiry does not transfer ownership to us or give us permission to publish it as marketing content.
Third-party websites
The website may link to client websites, reference material, or other third-party services. Those services are controlled by their operators and may have separate terms and privacy notices. We are not responsible for third-party content, availability, or practices, and a link does not amount to a guarantee or endorsement.
Availability and accuracy
We aim to keep the website useful and accurate, but content may change and may contain errors or become outdated. We may update, suspend, or discontinue parts of the website. To the extent permitted by law, the website is provided on an "as is" and "as available" basis without a guarantee of uninterrupted availability, complete accuracy, or fitness for a particular purpose.
Examples and descriptions of work do not guarantee that another project will achieve the same outcome. Any commitments about paid services must be stated in the applicable client agreement.
Responsibility and legal rights
To the extent permitted by applicable law, Paertner is not liable for indirect or consequential losses, lost profits, or lost business opportunities arising from use of, or inability to use, this website. This limitation concerns the website and does not change liability agreed in a separate client contract.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, or any liability that cannot lawfully be excluded or limited. Nothing removes mandatory consumer protections or other rights you have under applicable law. If a provision is unenforceable, the remaining provisions continue to apply to the extent legally permitted.
Privacy
Our Privacy Notice explains how we handle information collected through the website and inquiries. Please read it before submitting personal information. These terms do not authorize uses of personal information beyond those described in that notice or otherwise permitted by law.
Governing law
These terms and disputes relating to use of the website are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-law rules. This choice does not deprive you of mandatory protections or rights to bring proceedings in a court that applicable law gives you. A separate client agreement may specify different provisions for the services it covers.
Changes and questions
We may revise these terms as the website or our business changes. The effective date above identifies the current version. Revisions apply to website use from their effective date and do not retroactively change a signed client agreement. We will provide any additional notice required by law.
If you have a question or concern about the website, these terms, or permission to use content, contact hello@paertner.com. We encourage you to contact us so we can try to resolve the issue. This does not prevent you from exercising legal rights or seeking remedies available under applicable law.
